This advisory is the second of two in an important series of HOA Advisories related to the effects of HB25-1043.
As mentioned in a previous HOA Advisory, House Bill 25-1043 was passed by the Colorado General Assembly earlier in 2025 and takes effect October 1, 2025. This new law requires most associations in Colorado to update their policies and procedures related to collections.
For purposes of this HOA Advisory, HB25-1043 requires associations that provide a written notice to unit owners about curing any delinquency to inform the unit owner about the availability of, and instructions on how to access free online information through the HOA Information and Resource Center.
The HOA Information and Resource Center, in accordance with House Bill 25-1043, has added information to its website related to obtaining credit counseling for those who may be facing foreclosure, as well as more general information about the consequences of foreclosure by an association.
The HOA Information and Resource Center has prepared a useful website where this information can be located. Since the new law requires written notification to unit owners, board members, and Community Association Managers might consider providing a link directly to this information on the HOA Information and Resource Center’s website. It is important to note that the HOA Information and Resource Center does not provide credit counseling or housing counseling. Rather, the information provided by the HOA Center is designed to route consumers to appropriate resources and organizations that do provide the intended services.
